Civilized dialogue, excluding intimidations constitutes a defining condition for freedom of assembly, an important premise for ensuring free exchange of ideas, opinions and guaranteeing respecting democratic principles and rule of law

Referring to public manifestations which are announced to be organized on Sunday, June 16, People’s Advocates reiterate the admonishment for the participants to this event to exercise their right to freedom of assembly in the manner the Constitution of the Republic of Moldova provides and international documents to which the Republic of Moldova is part of.

The Ombudsman, Mihail Cotorobai makes appeal to the representatives of law enforcement to ensure the necessary measures for guaranteeing the safety of participants to manifestation in line with the law. Mihail Cotorobai emphasizes that intimidation actions or constraint of persons, involvement of people in public life, access to general interest information as well as avoiding the actions which would undermine the peaceful character of assemblies should not be admitted.

People’s Advocate for children’s rights, Maia Bănărescu, makes appeal to public authorities, parents/legal representatives to pay more attention in ensuring children’s protection and safety.

Ombudsmen specify that both, the Constitution of the Republic of Moldova in the article 40, Law on assemblies and the art. 11 of the Convention for the protection of human rights and fundamental freedoms confer protection only to peaceful assemblies.  In the international covenant on civil and political rights it is also mentioned that „The right to peaceful assembly shall be recognized. No restrictions may be placed on the exercise of this right other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order the protection of public health or morals or the protection of the rights and freedoms of others.”

Therefore, the political forces, NGO’s and peoples are advised for having a civilized dialogue, excluding intimidations and violent actions in order to ensure free exchange of ideas, opinions and guaranteeing respecting democratic principles and rule of law.
